BRITTIE PRO TERMS & CONDITIONS

These Terms & Conditions govern participation in the Brittie Pro Program operated by BrittieLLC (“Brittie,” “we,” “us,” or “our”). By creating, accessing, or purchasing through a Brittie Pro account, you agree to these Terms & Conditions.

1. PROFESSIONAL ELIGIBILITY

Brittie Pro accounts are intended for licensed estheticians, skincare professionals, medical professionals, spas, salons, and other approved beauty businesses. Brittie reserves the right to approve, deny, suspend, or terminate any professional account at its sole discretion. You agree to provide accurate and current information during the application and account approval process.

2. WHOLESALE ACCESS

Approved Brittie Pro accounts receive access to professional pricing, educational materials, and professional-use products. Wholesale pricing and benefits are confidential and may not be shared publicly. Brittie reserves the right to modify pricing, product availability, promotions, educational resources, program benefits, or account requirements at any time.

3. PROFESSIONAL USE PRODUCTS

Certain products, including Back Bar products, are intended for professional use only and may not be resold to consumers unless expressly authorized by Brittie. You are responsible for ensuring products are used, recommended, and applied appropriately within your scope of practice and applicable laws and regulations.

4. RESALE & MARKETPLACE RESTRICTIONS

Without prior written approval from Brittie, products may not be sold through Amazon, Walmart Marketplace, eBay, TikTok Shop, third-party marketplaces, unauthorized distributors, or any channel that may negatively impact the Brittie brand.

5. INTELLECTUAL PROPERTY

All Brittie trademarks, logos, product names, photographs, educational materials, videos, graphics, content, and intellectual property remain the exclusive property of BrittieLLC. Participation in Brittie Pro does not grant ownership or licensing rights to any intellectual property except as expressly permitted in writing.

6. PRODUCT CLAIMS

Professionals may not make false, misleading, medical, drug, disease-treatment, or unsubstantiated claims regarding Brittie products. All marketing and educational materials should be used in accordance with applicable laws, regulations, and industry standards.

7. ORDERS, SHIPPING & RETURNS

All orders are subject to product availability. Shipping times are estimates and are not guaranteed. Damaged or incorrect shipments must be reported within five (5) business days of delivery. Opened products are generally non-returnable unless required by law or otherwise approved by Brittie.

8. ACCOUNT TERMINATION

Brittie may suspend or terminate a professional account for violation of these Terms, misrepresentation of credentials, unauthorized resale, abuse of pricing programs, fraudulent activity, excessive chargebacks, payment disputes, or conduct deemed harmful to the Brittie brand. Upon termination, access to wholesale pricing, educational materials, and professional products may be revoked immediately.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, BrittieLLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of its products, services, educational materials, or professional program.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless BrittieLLC, its owners, officers, employees, contractors, affiliates, successors, and assigns from and against any claims, damages, liabilities, losses, costs, or expenses arising from your use, resale, recommendation, storage, application, marketing, or distribution of Brittie products.

11. NO MINIMUM ORDER REQUIREMENT

Brittie currently does not require minimum opening orders or minimum annual purchase requirements. However, Brittie reserves the right to modify account requirements, discontinue inactive accounts, or revise program eligibility standards at any time.

12. CHANGES TO TERMS

Brittie may update these Terms & Conditions at any time without prior notice. Continued use of a Brittie Pro account constitutes acceptance of any updated Terms & Conditions.

13. GOVERNING LAW

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Utah.
